Welcome to DigitalTab Pty Ltd (“Company”, “DigitalTab”, “we”, “us”, or “our”). These Terms & Conditions (“Terms”) govern your access to and use of DigitalTab’s websites, mobile applications, software platforms, and related services, including MediPlug, a patient engagement product developed and operated by DigitalTab (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

1. About DigitalTab and MediPlug

DigitalTab Pty Ltd is an Australian technology company providing digital solutions for healthcare practices and patients. MediPlug is one of DigitalTab’s products and is designed to support secure communication and engagement between medical practices and their patients.

Unless stated otherwise, all references to the “Services” in these Terms include MediPlug and any related DigitalTab products.

2. Account Registration

To access certain features of the Services, you may be required to create an account. You agree to:

  • Provide accurate, complete, and up-to-date information
  • Maintain the confidentiality of your login credentials
  • Notify DigitalTab immediately of any unauthorised access or use

You are responsible for all activity conducted through your account.

3. Use of Services

You agree to use the Services only for lawful purposes and in accordance with these Terms. You must not:

  • Misrepresent your identity or provide false information
  • Access or attempt to access data or accounts without authorisation
  • Interfere with the security, availability, or integrity of the Services
  • Use the Services in a manner that violates applicable laws or regulations

DigitalTab reserves the right to suspend or terminate access for any breach of these Terms.

4. Payments and Subscriptions

Where applicable:

  • Fees for paid Services are payable in accordance with the selected plan
  • Payments are processed securely through third-party payment providers
  • Refunds, if available, are governed by any applicable refund policy
  • DigitalTab may modify pricing, billing methods, or plans with or without prior notice, to the extent permitted by law

5. Intellectual Property

All intellectual property rights in the Services, including software, content, branding, logos, and documentation, are owned by or licensed to DigitalTab Pty Ltd.

You may not copy, modify, distribute, reverse engineer, or create derivative works from the Services without prior written consent from DigitalTab.

6. Data Ownership and Use

6.1 Data Ownership

  • DigitalTab owns only the data manually entered by users into DigitalTab systems, including configuration data, announcements, and administrative content created within the Services.
  • Clinical data, patient records, and source system data (including data originating from practice management systems such as Bp Premier) remain the property of the relevant medical practice or data controller.
  • Patients retain ownership of their personal information, subject to applicable laws.

6.2 Data Use

DigitalTab uses data solely to provide, operate, maintain, and improve the Services, in accordance with applicable privacy and healthcare regulations.

7. Security and Data Handling

DigitalTab implements industry-standard security controls to protect information processed through the Services, including:

  • MediPlug is CREST Certified
  • DigitalTab Pty Ltd is CyberCert Gold Certified

While reasonable safeguards are in place, no system can guarantee absolute security. Users are responsible for safeguarding their credentials and access devices.

8. User-Generated Content

If you submit or publish content through the Services (including messages, announcements, or administrative data):

  • You retain ownership of that content
  • You grant DigitalTab a non-exclusive, worldwide, royalty-free licence to use, host, store, and display the content solely for the purpose of providing the Services
  • You warrant that you have the legal right to submit such content

9. Health Information (Healthcare-Related Use)

Where the Services involve healthcare-related functionality:

  • DigitalTab processes health information in accordance with applicable Australian laws and healthcare data standards
  • MediPlug is intended to facilitate secure communication and engagement, not to replace clinical decision-making
  • Medical practices remain responsible for the accuracy and clinical use of patient data

10. Limitation of Liability

To the maximum extent permitted by law:

  • DigitalTab is not liable for indirect, incidental, special, or consequential damages arising from use of the Services
  • The Services are provided on an “as is” and “as available” basis
  • DigitalTab does not guarantee uninterrupted availability, error-free operation, or specific outcomes

11. Termination

DigitalTab may suspend or terminate access to the Services at its discretion, including for breach of these Terms or legal requirements. Users may terminate their use of the Services at any time by contacting DigitalTab.

12. Third-Party Services

The Services may integrate with third-party systems or software (including Bp Premier). DigitalTab is not responsible for third-party services, availability, or content. Use of third-party services is subject to their respective terms and conditions.

13. Governing Law

These Terms are governed by the laws of Australia, and you submit to the exclusive jurisdiction of the courts of Australia.

14. Changes to These Terms

DigitalTab may update these Terms from time to time. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
